Capital Punishment

Well, there is a reason not to have capital punishment, which appears to have been omitted from your poll.
It is very simple. What if you catch someone, try them, find them guilty, execute them, and then new evidence comes to light, which proves that they did not commit the crime?. Here in England, this would have happened a number of times, if we had the death penalty, but we don't.
Even today, in the 21st Century, it is notoriously difficult to prove beyond a shadow of doubt that a person committed a wicked crime. I am not totally against the death penalty, but I would not want to have the blood of someone on my hands, who was later found to be innocent.
If you want the death penalty, you must find a method of proving beyond any doubt whatsoever that the person is guilty. This is because (obviously) the penalty is not reversible. You can always let someone out of prison, but you can't bring them back from the grave. Have a nice day!

This is my issue too although I'm not against the death penalty, I do think it should be limited and shouldn't be used for anything but murder. Torture should never be used because

10% of those accused of rape haven't done it. Usually they have but the prison's have no way of knowing who the 90% are and who the 10% are. Also in the State of Washington in the early 90's 70% of child molesters in prison were not however 95% of the guilty one's weren't caught. That's coming from a counselor who deals with child molesters. It wasn't the children accusing them it was mainly child protective services who were interviewing the children with no eyewitnesses and with very open ended questions that can be interpreted in different ways not asking how certain things happened. For example, they ask if your step dad has ever seen you naked you say yes, but they don't ask how it happened and twice is considered an investigation three was on purpose and could be taken to court to at least remove the child until the complaint was proven false which was very difficult to do.

Another is issue is that some feel that after a man and woman start having sex and she changes her mind and he doesn't stop it's rape. Should he be executed?
